These Terms of Service govern your access to and use of the Appian Education platform, including all AI-powered tools, the Livia advisory interface, and any related services (collectively, the "Service"), operated by Appian Education LLC ("Appian," "we," or "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
01 Eligibility and Age Requirements
The Service is intended for users who are at least 13 years of age. By creating an account, you confirm that you are 13 years of age or older. Users under 13 are not permitted to use the Service, and we do not knowingly collect personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA).
If you are under 18, we recommend that a parent or guardian review these Terms and be aware of your use of the Service. By using the Service as a minor, you represent that a parent or guardian has reviewed and consented to these Terms on your behalf.
Account registration requires affirmative confirmation that you meet the age minimum. If we learn that a user is under 13, we will promptly delete the account and any associated data.
02 Nature of the Service — AI-Generated Content Disclaimer
Appian provides AI-powered tools to assist students and families in the college planning and application process.
Specifically, you acknowledge and agree that:
- AI-generated suggestions and feedback reflect probabilities and general patterns; they are not guarantees of outcome, admission, or fit.
- No output of the Service constitutes a guarantee of admission to any college, university, or academic program. The college admissions process is inherently unpredictable, and results will vary.
- You should exercise independent judgment and, where appropriate, consult a qualified professional before making significant educational or financial decisions.
- Appian is not responsible for outcomes resulting from decisions made in reliance on AI-generated content.
03 Academic Integrity and Acceptable Use
Appian's tools are designed to support the student's own thinking and writing — not to replace it. You agree that:
- All application materials submitted to colleges and universities must be your own original work. You may not submit AI-generated content as your own writing in college applications or any other academic context where such submission would constitute dishonesty or a violation of institutional policy.
- The Service may be used to brainstorm, refine, and improve your own ideas and drafts, but the final work must authentically represent you.
- You will not use the Service in any way that violates applicable laws, regulations, or the academic integrity policies of your school or any institution to which you apply.
- You will not attempt to reverse-engineer, scrape, or misuse the Service or its underlying systems.
04 Subscription, Billing, and Cancellation
Access to the Service requires a paid subscription at the current rate of $49 per month. A 14-day free trial is available to new users upon account creation. You will not be charged during the trial period, but a valid payment method is required to begin the trial.
- Billing. Following the trial period, your subscription renews automatically on a monthly basis. You authorize Appian to charge your payment method on file at the start of each billing cycle.
- Cancellation. You may cancel your subscription at any time through your account settings or by contacting hello@appian.education. Cancellation takes effect at the end of the current billing period.
- No Refunds. Subscription fees are non-refundable. We do not provide pro-rata refunds for unused portions of a billing period.
- Price Changes. We reserve the right to modify subscription pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new rate.
Premium human counseling services, where available, are offered separately on an inquiry basis and are governed by a separate agreement.
05 Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly at hello@appian.education if you become aware of any unauthorized use of your account. Appian is not liable for any loss resulting from unauthorized use of your account.
06 Intellectual Property
The Service, including its design, software, AI systems, and all content created by Appian, is owned by Appian Education LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial college planning purposes.
Content you submit to the Service (essays, activity descriptions, personal information) remains yours. By submitting content, you grant Appian a limited license to process that content solely for the purpose of providing the Service to you, as described in our Privacy Policy.
07 Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. APPIAN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPIAN'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO APPIAN IN THE THREE MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL APPIAN BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST OPPORTUNITIES OR ADMISSION OUTCOMES.
08 Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Fairfax County, Virginia, and you consent to personal jurisdiction in those courts.
09 Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and, for material changes, notify you via email or a prominent notice within the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
